An older official document can remain online after its rule has changed. For Virginia live-in EVV, the effective date is essential.
The current notice
Virginia DMAS issued a bulletin on September 9, 2026 stating that the live-in exemption from EVV requirements is removed effective October 1, 2026. The notice covers personal care/assistance, respite and companion services and addresses both agency-directed and consumer-directed services.
As of this article’s October 18, 2026 source check, that effective date has passed. This publication therefore does not repeat the older claim that live-in caregivers are exempt in Virginia. Historical 2020 or 2021 materials describing an exemption should not be used as current instructions without checking the later bulletin.
Portal time entry and EVV are not identical
For consumer-directed services, the bulletin requires use of the fiscal/employer agent’s mobile application or interactive voice response system. It states that time entered only through a web portal does not meet EVV compliance requirements. Seeing an entry in a portal is therefore not enough to infer that the required verification method was used.
This article does not identify the proper method for an individual reader, establish their fiscal/employer agent, or determine whether a particular service or visit is compliant. Use the bulletin and your current official program instructions together. Ask the authorized support contact about method access, training and any individual application question.
Read three dates separately
- Publication date: September 9, 2026, when the bulletin was issued
- Effective date: October 1, 2026, when the stated change takes effect
- Our source check: October 18, 2026, when the public reference was reviewed for this article
The date you downloaded a PDF is a fourth, different date. A document downloaded today can still describe an older rule. Search ranking and a recent file timestamp do not establish policy authority.
A fictional conflicting-document case
A reader has an old exemption handout and a newer bulletin. Both appear on official sites. The reader compares the topic, affected service and effective date, then asks the current program contact how to follow the newer requirement. The reader does not assume the old handout remains controlling because it is easier to understand.
If access is the obstacle
Describe the barrier without sending private visit data: for example, which approved method you were instructed to use and what interaction is unavailable. Ask what authorized alternative or accessibility support applies. Do not assume that returning to portal-only entry resolves the requirement or that a general internet guide can grant an exception.
Use the support-note method to organize that question. For state-specific program materials, Virginia’s public forms directory and the Consumer Direct support directory are starting points. This is a dated explanation of public evidence, not legal advice or a decision about benefits, services or payment.
Sources and limits
Official public sources checked October 18, 2026. Practical examples and reading methods are original editorial analysis, not official procedures. No private account or visit record was inspected.
